2. Your rights when you use our website

You have

  • the right, pursuant to Art. 15 GDPR, to access your data stored by us, which is collected during your visit to the website and your use of the online shop;
  • the right, pursuant to Art. 16 GDPR, to demand the correction of incorrect personal data or the completion of incomplete personal data stored by us;
  • the right, pursuant to Art. 17 GDPR, to demand the deletion of your personal data that is stored by us, unless the processing of the data is necessary for the fulfilment of a legal obligation or for the assertion, exercise or defence of legal claims;

4.1 Collection of personal data when you visit our website

1. This personal data shall be processed solely to handle the enquiry. Within our company, the bodies that require your data to deal with your enquiry shall receive access to it.
The user shall have the option of objecting to the data processing. The objection must be sent to the contact details above.

 

2. Use of our online shop

The user can create a user account and make purchases on the website, providing his/her personal data. The mandatory information required for this shall be specified in the registration form and shall be marked separately; other information shall be voluntary. We shall process the data provided by you for the execution of your order. The legal basis for this is Art. 6 (1) b) GDPR (performance of a contract). You may delete your customer account at any time by sending a message to the contact options above.

 

5. Recipients of personal data

Access to the collected data is only possible for an authorised group of employees. Access is also restricted to the data that is necessary for the performance of the respective task.

 

In order to provide our contractual services, we employ selected service providers (processors) and vicarious agents from the categories below, who may receive access to your data to the necessary extent and shall use it for the performance of the orders placed by us.

Newsletter mailing

If you have provided us with your e-mail address when purchasing goods, we reserve the right to regularly send you offers by e-mail relating to goods from our product range that are similar to those that you have already bought. In this respect, the data processing shall take place on the basis of our legitimate interest in personalised direct marketing pursuant to Art. 6 (1) f) GDPR in conjunction with Section 7 (3) German Act Against Unfair Competition (UWG). If you objected to the use of your e-mail address for this purpose at the outset, we shall not send you e-mails.

 

Please be aware that the newsletters contain a so-called “web beacon”, i.e. a pixel-sized file, that is retrieved when the newsletter is opened. It is initially technical information, such as information regarding the browser and your system, that is collected in this retrieval. The statistics gathered shall also include information on whether the newsletters are opened, when they are opened and which links are clicked. This information shall be used for the technical improvement of the newsletter and to identify the users’ reading habits so that the contents of the newsletters can be adapted accordingly. The legal basis for this is Art. 6 (1) f) GDPR.

 

You are entitled to object to the use of your e-mail address for the aforementioned advertising purpose at any time with effect for the future by notifying the controller referred to at the top of the data privacy statement. You shall only incur transmission costs at the basic rates for this. After your objection is received, the use of your e-mail address for advertising purposes shall be stopped immediately. A separate cancellation of the performance measurement is not possible. In this case, the entire newsletter subscription must be cancelled.

With your consent, you can subscribe to our newsletter, in which we will inform you about our latest interesting offers. The legal basis is Art. 6 (1) Sentence 1 a) GDPR.

 

We use the so-called double opt-in process for subscription to our newsletter. This means that, after your subscription, we shall send you an e-mail to the provided e-mail address, in which we ask you to confirm that you want us to send you the newsletter. If you don’t confirm this, your subscription shall be deleted automatically. If you confirm your wish to receive the newsletter, we shall save your e-mail address until you unsubscribe from the newsletter. We shall also save your IP addresses and the times of the subscription and confirmation. The purpose of this process is to provide evidence of your subscription and, if applicable, to be able to explain a possible misuse of your personal data.

On the basis of our legitimate interest in personalised direct marketing, we reserve the right to store your first name and surname and your postal address pursuant to Art. 6 (1) f) GDPR and to use them to post you interesting offers and information relating to our products.

7. Analysis of the user behaviour

1. Use of Emarsys

In order to display personal product recommendations for you in the shop, we use the service provider Emarsys eMarketing Systems AG, Hans-Fischer-Str 10, 80339 München, Germany (“Emarsys”). To this end, cookies are set when the website is accessed, provided that the user consents to this. The legal basis is Art. 6 (1) a) GDPR. Two types of information are recorded either anonymously (before login to the online shop) or in a pseudonymised form (after log in to the online shop):

 

  • Service information that relates to the operation of the data collection service
  • Browsing information (product numbers that have been viewed or placed in the shopping cart etc.)

 

The expiry date for the cookies is one year, with the exception of the session cookie that is deleted at the end of each session.

 

2. Use of Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. (“Google”), provided that you have given your consent to this in accordance with Art. 6 (1) a) GDPR. This includes the operation mode Universal Analytics. This mode makes it possible to assign data, sessions and interactions across several devices to a pseudonymous user ID and thus to analyse the activities of a user across different devices.

 

Google Analytics uses so-called “cookies”, text files which are stored on your computer and enable your use of the website to be analysed. The information about your use of this website generated by the cookie is usually transferred to a Google server in the USA, where it is stored. In the event that IP-anonymisation is activated on this website, your IP-address will, however, be shortened first by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. 3. Use of Google AdWords Conversion

We have integrated Google AdWords into our website. Google AdWords is an online advertising service that allows advertisers to place advertisements in Google’s search engine results and in the Google advertising network. Google AdWords allows an advertiser to define predetermined keywords which enable an advertisement to be displayed in Google’s search engine results only if the user uses the search engine to call up a search result related to these keywords. In the Google advertising network, the advertisements are distributed across thematically relevant webpages by means of an automatic algorithms and allowing for the predefined keywords.

 

The operating company for the Google AdWords services is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

 

The purpose of Google AdWords is the promotion of our website by inserting interest-related advertising into the webpages of third party companies and into the search results of the Google search engine and an insertion of external advertising into our website.

 

If you access our website via a Google advertisement, a so-called conversion cookie will be stored on your system by Google. A conversion cookie loses its validity after thirty days and is not used to identify you. If the cookie has not yet expired, the conversion cookie will be used to assess whether certain subpages, for example the shopping cart in an online shop system, have been accessed on our website. Both we and Google can use the conversion cookie to assess whether the user who has accessed our website via an AdWords advertisement has generated sales, i.e. has completed or aborted a purchase of goods.

4. Use of Hotjar

The service Hotjar from Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe, + 1 (855) 464-6788, support@hotjar.com is used on the website, provided that you have consented to this in accordance with Art. 6 (1) a) GDPR.


This tool can be used to track the activities on the websites on which Hotjar is used (so-called heat maps). In this way, we receive information to optimise our website for our users.


This tool enables us to identify which buttons are clicked, the progress of the mouse, how far the user scrolls, the screen size of the device, the device type and browser information, the geographical location (just the country) and the preferred language. This gives us useful information for making our websites even faster and even more customer-friendly. All entries of your own and third party personal data in forms are automatically hidden by Hotjar and are not recorded.
Hotjar provides every user with the option of preventing the use of the Hotjar tool, with the help of a “Do Not Track” header, so that no data about your visit to the respective website is recorded. This is a setting that all common browsers support in their latest versions. 8. Use of Google web fonts

On the website, we use Google Fonts from the provider Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland for the uniform presentation of fonts. 9. Use of the Google Tag Manager

The Google Tag Manager, a service of Google Inc. (“Google”), is used on the website. This service allows website tags to be managed via an interface.

 

The Tag Manager tool itself (which implements the tags) is a cookie-free domain and does not record any personal data. The tool triggers other tags, which may record data. Google Tag Manager does not access this data. If the tool has been disabled at a domain or cookie level, this will remain in effect for all tracking tags that are implemented with the Google Tag Manager.

 

10. Integration of Google Maps

On our website, we use Google maps (API) from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Maps is a web service for the presentation of interactive maps, in order to present geographical information visually. Use of this service may, for example, show you our location and make it easier for you to find your way to us.

If you do not agree to the future transmission of your data to Google within the framework of the use of Google Maps, there is also the option of completely disabling the Google Maps web service by turning off the JavaScript application in your browser. 11. Integration of the Trusted Shops Trustbadge

The Trusted Shops Trustbadge is integrated into our website to display our Trusted Shops seal of quality and the collected reviews and to offer the Trusted Shops products for buyers after an order.

 

It serves to protect our legitimate interests in an optimal marketing of our offer pursuant to Art. 6 (1) f) GDPR, which are predominant in a weighing up of interests. The Trustbadge and the services provided with it are provided by Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Köln. When the Trustbadge is called up, the web server automatically stores a so-called server log file which contains, for example, your IP address, the data and time of retrieval, the transferred data volume and the requesting provider (access data), and documents the retrieval. This access data will not be analysed and will be automatically overwritten no later than seven days after the end of your visit to the website. Other personal data will only be transferred to Trusted Shops if you have given your consent to this, have chosen to use Trusted Shops products after completing an order or have already registered for the use. In this case, the contractual agreement between you and Trusted Shops shall apply.

 

12. Duration of the storage of the personal data

We shall process and store your personal data for as long as this is necessary for the fulfilment of the aforementioned obligations, in particular our contractual and statutory obligations. If the data is no longer necessary for the fulfilment of these purposes and our obligations, it shall be deleted regularly, unless its – limited – further processing is necessary for the following purposes:

 

  • performance of storage obligations under commercial and tax law: in particular the German Commercial Code and the German Fiscal Code. The terms specified there for storage or documentation amount to six to ten years.
  • The preservation of proof in the context of the statutory statute of limitations. In accordance with Sections 195 ff. of the German Civil Code (BGB), these limitation periods may amount to up to 30 years, whereby the regular limitation period shall be three years.

We maintain profiles in the social networks Instagram, Pinterest, Facebook and YouTube, in order to communicate with the registered users and to inform them about our products, services and news. We have no influence on the processing of personal data by the respective social media provider.
